By accessing or using the babygator website, joining our waitlist, or interacting with our content, you agree to these Terms of Use. If you do not agree, please discontinue use of the site.

About babygator

babygator is a behavior‑aware safety accessory designed to work with most frame‑based baby gates. It is not a baby gate, does not replace a baby gate, and must only be used with a properly installed, manufacturer‑rated gate.
babygator is currently in pre‑launch development. Product details, features, and specifications may change before final release.

Pre‑Launch Information and Waitlist

• Joining the babygator waitlist provides early updates, launch notifications, and access to founder perks.
• Joining the waitlist does not guarantee product delivery, availability, or fulfillment.
• Kickstarter timelines, production schedules, and delivery estimates may change due to factors outside our control, including manufacturing, testing, supply chain, and certification processes.
• No purchase obligation is created by joining the waitlist.

Proper Use and Safety

• You agree to use babygator only as intended and only with compatible gate types.
• babygator must be installed on a structurally sound, frame‑based gate.
• babygator must not be used with fabric, mesh, expandable, or retractable gates.
• babygator does not change the safety rating of your gate.
• Always follow your gate manufacturer’s age, height, and installation guidelines.
• Adult supervision is required around all baby gates and safety products.
• Improper installation or use may reduce effectiveness.

No Professional or Safety Guarantees

babygator is designed to reduce climbing behavior by removing leverage points, but no child‑safety product can guarantee complete prevention of climbing, falls, or injury. You acknowledge that:

• All children behave differently.
• No containment system is fail‑proof.
• Parents remain responsible for monitoring their children.

We do not provide professional safety, medical, or behavioral advice.

Early Testing and Certification

We have conducted small‑scale, observational testing with toddlers to inform design. These tests are preliminary and not a substitute for independent lab certification. Formal testing and certification are in progress and will be published when available.

Intellectual Property

All content on this site—including designs, images, text, branding, and product concepts—is owned by babygator and protected by intellectual property laws. You may not copy, reproduce, or distribute any content without written permission.

User‑Submitted Photos, Videos, and Testimonials

• If you submit photos, videos, reviews, testimonials, or other content to babygator (including compatibility photos sent to our email), you grant us a limited license to:
  • View, store, and use the content solely for compatibility confirmation, customer support, or product improvement.
  • Request your permission before using any photo, video, or testimonial for marketing, advertising, or promotional purposes.
• You retain full ownership of your content.
• We will never publish or share your submissions publicly without your explicit written consent.

Third‑Party Services

We may use third‑party providers for email management, analytics, hosting, and payment processing (once launched). These providers may access your information only as needed to perform services on our behalf.

Limitation of Liability

• Misuse or improper installation of the product
• Use with incompatible gates
• Failure to follow manufacturer instructions
• Injuries or incidents occurring with or around baby gates
• Delays in product availability or delivery
• Errors or interruptions on the website

To the fullest extent permitted by law, babygator is not liable for the above. Your use of the product and website is at your own risk.

Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, and pre-launch information are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Dispute Resolution and Governing Law

Any dispute arising out of or related to these Terms, the website, or babygator products will be resolved on an individual basis and not as a class action, except where prohibited by applicable law. These Terms are governed by the laws of the state or province where babygator's principal business operations are located, without regard to conflict-of-law principles.

Indemnification

You agree to defend, indemnify, and hold harmless babygator and its officers, directors, team members, and affiliates from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the website or product, violation of these Terms, or violation of applicable law.

Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, form the entire agreement between you and babygator regarding use of the website and waitlist.

Changes to These Terms

We may update these Terms of Use as our product and business evolve. The “Last Updated” date will reflect any changes. Continued use of the site means you accept the updated terms.
